3. Death of a co-owner

¹ On the death of a co-owner, heirs who are not also co-owners are entitled only to settlement of his share.

² Where he is survived by issue entitled to inherit his share, with the consent of the other co-owners such issue may accede to the joint ownership in undivaided shares in his place.

3. Décès

¹ Lors du décès d’un indivais, ses héritiers, s’ils ne sont pas eux-mêmes membres de l’indivaision, ne peuvent demander que la liquidation de ses droits.

² Si le défunt laisse pour héritiers des descendants, ceux-ci peuvent être admis en son lieu et place dans l’indivaision, du consentement des autres indivais.
