Art. 47 Nachträgliche Kontrolle (Marktüberwachung) nach anderen Erlassen

1 Die nachträgliche Kontrolle (Marktüberwachung) wird durchgeführt:

a.
bei Arzneimitteln nach dem Heilmittelgesetz vom 15. Dezember 200060;
b.
bei Lebensmitteln und Gebrauchsgegenständen nach dem Lebensmittelgesetz vom 9. Oktober 199261;
c.
bei pflanzlichem Vermehrungsmaterial für ausschliesslich forstwirtschaftliche Verwendungen nach der Waldverordnung vom 30. November 199262;
d.
bei pflanzlichem Vermehrungsmaterial für alle übrigen Verwendungen nach der Saatgut-Verordnung vom 7. Dezember 199863;
e.
bei Pflanzenschutzmitteln nach der Pflanzenschutzmittelverordnung vom 18. Mai 200564;
f.
bei Düngern nach der Dünger-Verordnung vom 10. Januar 200165;
g.
bei Futtermitteln nach der Futtermittel-Verordnung vom 26. Mai 199966;
h.
bei immunologischen Arzneimitteln für den tierärztlichen Gebrauch nach dem Heilmittelgesetz vom 15. Dezember 2000;
i.67

bei Biozidprodukten nach der Biozidprodukteverordnung vom 18. Mai 200568.

2 Die zuständige Behörde informiert das BAFU und das BAG über die von ihr erlassenen Verfügungen, falls Bestimmungen dieser Verordnung betroffen sind.

3 Die für die Kontrollen erforderlichen Proben, Nachweismittel und -methoden sind den zuständigen Behörden zur Verfügung zu stellen.

4 Ergibt die Kontrolle, dass Bestimmungen dieser Verordnung verletzt werden, so muss die verantwortliche Person die Kosten der Kontrolle tragen.

Art. 47 Subsequent monitoring (supervising the market) in accordance with other regulations

1 Subsequent monitoring (supervising the market) shall be carried out:

a.
for therapeutic products in accordance with the Therapeutic Products Act of 15 December 200060;
b.
for foodstuffs and utensils in accordance with the Foodstuffs Act of 9 October 199261;
c.
for plant propagation materials exclusively for use in forests in accordance with the Forests Ordinance of 30 November 199262;
d.
for plant propagation materials for all other uses in accordance with the Seeds Ordinance of 7 December 199863;
e.
for plant protection products in accordance with the Plant Protection Products Ordinance of 18 May 200564;
f.
for fertilisers in accordance with the Fertilisers Ordinance of 10 January 200165;
g.
for animal feedstuffs in accordance with the Feedstuffs Ordinance of 26 May 199966;
h.
for immunological products for veterinary use in accordance with the Therapeutic Products Act of 15 December 2000;
i.67

for biocidal products in accordance with the Biocidal Products Ordinance of 18 May 200568.

2 The responsible authority shall inform the FOEN and FOPH about orders it has issued, if the requirements of this Ordinance are affected.

3 The samples, detection methods and materials required for monitoring shall be made available to the competent authorities.

4 If the monitoring shows that provisions of this Ordinance have been contravened, the person responsible shall bear the costs of the monitoring.
