Art. 9 Protection of groundwater

1 Subject to paragraph 1bis, a polluted site is deemed to be in need of monitoring to protect the groundwater, if:

a.
any of the concentration values specified in Annex 1 is exceeded in the eluate of the material at the site; or
b.
for groundwater water protection areas Au, the concentration of substances originating from the site immediately downstream of the site exceeds 10% of one of the concentration values specified in Annex 1; or
c.
for groundwater outside water protection areas Au, the concentration of substances originating from the site immediately downstream of the site exceeds 40% of one of the concentration values specified in Annex 1.3

1bis If after several years of monitoring a site, it is established that, considering the evolution of pollutant concentrations and the characteristics of the site, it is highly probable that the site will not need remediation under paragraph 2, the site is deemed no longer to be in need of monitoring.4

2 A polluted site is deemed to be in need of remediation to protect the groundwater, if:

a.5
potential water pollutants originating from the site are detected in groundwater catchments of public interest in concentrations that exceed the detection threshold;
b.6
for groundwater in water protection areas Au7: the concentration of substances originating from the site immediately downstream of the site exceeds one-half the concentration value specified in Annex 1;
c.8
for groundwater outside water protection area Au s: the concentration of substances originating from the site immediately downstream of the site exceeds double the concentration value specified in Annex 1; or
d.
it is in need of monitoring in accordance with paragraph 1 letter a, and, owing to insufficient retention capacity, or degradation of substances originating from the site, there is a real danger of groundwater pollution.

Art. 9 Schutz des Grundwassers

1 Ein belasteter Standort ist unter Vorbehalt von Absatz 1bis hinsichtlich des Schutzes des Grundwassers überwachungsbedürftig, wenn:

a.
im Eluat des Materials des Standortes ein Konzentrationswert nach Anhang 1 überschritten ist;
b.
bei Grundwasser im Gewässerschutzbereich Au: im Abstrombereich unmittelbar beim Standort die Konzentration von Stoffen, die vom Standort stammen, 10 Prozent eines Konzentrationswertes nach Anhang 1 überschreitet; oder
c.
bei Grundwasser ausserhalb des Gewässerschutzbereichs Au: im Abstrombereich unmittelbar beim Standort die Konzentration von Stoffen, die vom Standort stammen, 40 Prozent eines Konzentrationswertes nach Anhang 1 überschreitet.3

1bis Steht bei einem Standort nach mehrjähriger Überwachung fest, dass aufgrund des Verlaufs der Schadstoffkonzentration und der Standorteigenschaften mit grosser Wahrscheinlichkeit kein Sanierungsbedarf nach Absatz 2 zu erwarten ist, so ist der Standort nicht mehr überwachungsbedürftig.4

2 Ein belasteter Standort ist hinsichtlich des Schutzes des Grundwassers sanierungsbedürftig, wenn:

a.5
bei Grundwasserfassungen, die im öffentlichen Interesse liegen, vom Standort stammende Stoffe, die Gewässer verunreinigen können, in Konzentrationen über der Bestimmungsgrenze festgestellt werden;
b.6
bei Grundwasser im Gewässerschutzbereich Au7: im Abstrombereich unmittelbar beim Standort die Konzentration von Stoffen, die vom Standort stammen, die Hälfte eines Konzentrationswerts nach Anhang 1 überschreitet;
c.8
bei Grundwasser ausserhalb des Gewässerschutzbereichs Au: im Abstrombereich unmittelbar beim Standort die Konzentration von Stoffen, die vom Standort stammen, das Zweifache eines Konzentrationswerts nach Anhang 1 überschreitet; oder
d.
er nach Absatz 1 Buchstabe a überwachungsbedürftig ist und wegen eines ungenügenden Rückhalts oder Abbaus von Stoffen, die vom Standort stammen, eine konkrete Gefahr einer Verunreinigung des Grundwassers besteht.
