Art. 12 Schutz von Menschen, Tieren, Umwelt und biologischer Vielfalt vor pathogenen Organismen

¹ Der Umgang mit pathogenen Organismen in der Umwelt muss so erfolgen, dass dadurch weder Menschen, Tiere und Umwelt gefährdet noch die biologische Vielfalt und deren nachhaltige Nutzung beeinträchtigt werden, insbesondere dass:

a.: die Gesundheit von Menschen und Tieren nicht gefährdet werden kann, insbesondere nicht durch toxische oder allergene Stoffe oder durch die Verbreitung von Antibiotikaresistenzen;
b.: die Organismen sich in der Umwelt nicht unkontrolliert verbreiten und vermehren können;
c.: die Populationen geschützter Organismen, insbesondere solcher, die in den Roten Listen aufgeführt sind, oder für das betroffene Ökosystem wichtiger Organismen, insbesondere solcher, die für das Wachstum und die Vermehrung von Pflanzen wichtig sind, nicht beeinträchtigt werden;
d.: keine Art von Nichtzielorganismen in ihrem Bestand gefährdet werden kann;
e.: der Stoffhaushalt der Umwelt nicht schwerwiegend oder dauerhaft beeinträchtigt wird;
f.: wichtige Funktionen des betroffenen Ökosystems, insbesondere die Fruchtbarkeit des Bodens, nicht schwerwiegend oder dauerhaft beeinträchtigt werden.

² Mit pathogenen Organismen, die nach Artikel 6 ESV²⁴ der Gruppe 3 oder 4 zugeordnet werden oder die invasiv sind, darf in der Umwelt nicht direkt umgegangen werden; vorbehalten bleibt ihr primärer Nachweis nach Artikel 5a ESV.²⁵

Art. 12 Protection of human beings, animals, the environment and biological diversity from pathogenic organisms

¹ The handling of pathogenic organisms in the environment must be carried out in such a manner that it neither endangers human beings, animals or the environment nor harms biological diversity or the sustainable use thereof, and in particular so that:

a.: the health of human beings and animals cannot be endangered, in particular not by toxic or allergenic substances or through the spread of antibiotic resistances;
b.: the organisms cannot spread or multiply in an uncontrolled way in the environment;
c.: populations of protected organisms are not harmed, in particular those included in the Red Lists, or organisms that are important for the ecosystem in question, in particular those that are important for the growth and reproduction of plants;
d.: no species of non-target organisms species can be endangered;
e.: the material balance of the environment is not severely or permanently harmed;
f.: important functions of the ecosystem in question, in particular the fertility of the soil, are not severely or permanently harmed.
