814.600 Ordinance of 4 December 2015 on the Avoidance and the Disposal of Waste (Waste Ordinance, ADWO)
Art. 39 Errichtungsbewilligung
1 Die kantonale Behörde erteilt die Errichtungsbewilligung für eine Deponie oder ein Kompartiment, wenn:
- a.
- der Bedarf an Deponievolumen sowie der Standort der Deponie in der Abfallplanung ausgewiesen ist;
- b.
- die nach Artikel 36 geltenden Anforderungen an Standort und Bauwerk von Deponien eingehalten sind.
2 Sie legt in der Errichtungsbewilligung fest:
- a.
- den Typ der Deponie oder des Kompartiments;
- b.
- allfällige Beschränkungen der nach Anhang 5 zugelassenen Abfälle;
- c.
- weitere Auflagen und Bedingungen, die zur Einhaltung der Umwelt- und Gewässerschutzgesetzgebung erforderlich sind.
Art. 39 Construction permit
1 The cantonal authority shall grant the construction permit for a landfill or a compartment provided:
- a.
- the requirements for landfill volume and the location of the landfill are indicated in the waste management plan;
- b.
- the requirements under Article 36 for the location and building of landfills are met.
2 In the construction permit, it shall specify:
- a.
- the type the landfill or of the compartment;
- b.
- any restrictions on the acceptable waste in accordance with Annex 5;
- c.
- further requirements and conditions that are necessary for compliance with the environmental and waters protection legislation.
