812.21 Federal Act of 15 December 2000 on Medicinal Products and Medical Devices (Therapeutic Products Act, TPA)
Art. 49 Instandhaltungspflicht
1 Wer ein Medizinprodukt gewerblich oder an Dritten einsetzt, muss dabei alle Massnahmen für die Instandhaltung treffen, die für die Erhaltung der Leistung und der Sicherheit des Medizinproduktes erforderlich sind.
2 Der Bundesrat kann:
- a.
- für bestimmte Medizinprodukte oder Medizinprodukteklassen festlegen, wie sie in Stand gehalten werden müssen;
- b.
- das Nachweisverfahren für die Erfüllung der Instandhaltungspflicht und der Instandhaltungsanforderungen festlegen;
- c.
- die Instandhaltung von fachlichen Voraussetzungen abhängig machen.
Art. 49 Obligation of maintenance
1 Any person who uses a medical device commercially or who uses it on a third party shall be obliged to take all the necessary measures for the maintenance of such device to ensure the continued performance and the safety of the medical device.
2 The Federal Council may:
- a.
- specify the type of maintenance required for certain medical devices or certain classes of medical devices;
- b.
- regulate the procedure for proving that the obligation of maintenance and the relative requirements have been fulfilled;
- c.
- make the maintenance dependent upon the technical conditions.
