702.1 Second Homes Ordinance of 4 December 2015 (SHO)

Art. 3 Menziun en il register funsil

1 La servitut che sto vegnir menziunada tenor lescha en il register funsil per las abitaziuns che han ina restricziun d’utilisaziun, tuna sco suonda:

a.
emprima abitaziun u abitaziun che ha il medem status sco in’emprima abitaziun tenor l’artitgel 7 alinea 1 litera a da la lescha;
b.
abitaziun explotada turisticamain tenor l’artitgel 7 alinea 2 litera a da la lescha (abitaziun annexa); u
c.
abitaziun explotada turisticamain tenor l’artitgel 7 alinea 2 litera b da la lescha (abitaziun en il rom d’ina interpresa d’alloschament organisada).

2 La menziun en il register funsil cumpiglia – supplementarmain a l’abitaziun respectiva – l’identificatur d’edifizis e l’identificatur d’abitaziuns tenor l’artitgel 8 alineas 2 litera a e 3 litera a da l’Ordinaziun dals 9 da zercladur 20174 davart il register federal dals edifizis e da las abitaziuns.5

Art. 3 Note in the land register

1 The condition of use that must be noted in the land register in respect of homes with restriction on use in accordance with Act is worded as follows:

a.
principal home or home deemed equivalent to a principal home in accordance with Article 7 paragraph 1 letter a of the Act;
b.
home managed as tourist accommodation in accordance with Article 7 paragraph 2 letter a of the Act; or
c.
home managed as tourist accommodation in accordance with Article 7 paragraph 2 letter b of the Act (home forming part of an organised accommodation complex).

2 The note in the land register further includes the building and dwelling identifier for the home concerned in accordance with Article 8 paragraphs 2 letter a and Article 3 letter a of the Ordinance of 9 June 20174 on the Federal Register of Buildings and Dwellings.5

3 The commune may record the restriction on use in the RBD.
