Art. 7 Immissione nelle canalizzazioni pubbliche

1 L’autorità concede l’autorizzazione ad immettere nelle canalizzazioni pubbliche acque di scarico industriali secondo l’allegato 3.2 oppure altre acque di scarico secondo l’allegato 3.3 se sono soddisfatte le esigenze del relativo allegato.

2 L’autorità può rendere più severe o completare le esigenze se, con l’immissione delle acque di scarico:

a.
l’esercizio delle canalizzazioni pubbliche può risultare più gravoso o perturbato;
b.
per le acque di scarico della stazione centrale di depurazione delle acque le esigenze relative all’immissione in un ricettore naturale non possono essere rispettate o possono esserlo soltanto con misure sproporzionate, o l’esercizio dell’impianto può in altro modo risultare più gravoso o perturbato; oppure
c.8

l’esercizio dell’impianto in cui vengono inceneriti i fanghi può risultare più gravoso o perturbato.

3 L’autorità può rendere meno severe le esigenze se:

a.
con una riduzione del volume delle acque di scarico immesse, benché siano autorizzate concentrazioni più elevate di sostanze, viene ridotta la quantità di sostanze immesse che sono suscettibili di inquinare le acque;
b.
con l’immissione di sostanze non riciclabili nelle acque di scarico industriali si grava sull’ambiente in misura complessivamente minore che non con un’altra forma di smaltimento, e per le acque di scarico della stazione centrale di depurazione si rispettano le esigenze relative all’immissione in un ricettore naturale; oppure
c.
questa misura è opportuna per l’esercizio dell’impianto di depurazione delle acque.

Art. 7 Discharge into public sewers

1 The authorities shall authorise discharge of waste water from industry according to Annex 3.2 or of other waste water according to Annex 3.3 into public sewers if the requirements of the relevant Annex are complied with.

2 They shall set additional or stricter requirements if by discharge of waste water:

a.
operation of public sewers may be restricted or disrupted;
b.
in the case of waste water from the central waste water treatment plant, the requirements on discharge into a body of water are not met or may only be met by disproportionate measures, or could restrict or disrupt the operation of the plant in another way; or
c.8

d.
the operation of the plant in which sludge is incinerated may restricted or disrupted.

3 They may apply less stringent requirements if:

a.
by reducing the amounts of waste water discharged, fewer potential water pollutants are discharged even though the concentrations allowed are higher;
b.
the environment as a whole will be less impaired by the discharge of non-recyclable substances in industrial waste water than by another disposal method, and in the case of waste water from the central waste water treatment plant, requirements on discharge into a body of water are met; or
c.
this is appropriate for the operation of the waste water treatment plant.
