Quiconque, intentionnellement, n’aura pas exécuté, ou ne l’aura fait qu’en partie, une décision des autorités en matière de concurrence concernant l’obligation de renseigner (art. 40), aura réalisé une concentration d’entreprises sans procéder à la notification dont elle aurait dû faire l’objet ou aura violé des décisions liées à des concentrations d’entreprises, sera puni d’une amende de 20 000 francs au plus.
Any person who wilfully does not, or does not fully comply with a ruling of the competition authorities concerning the obligation to provide information (Art. 40), who implements a concentration that should have been notified without filing a notification, or who violates rulings relating to concentrations of undertakings is liable to a fine not exceeding 20,000 Swiss francs.
