Art. 11 Recognition

1 An inspection body may be recognised if it fulfils the following requirements:

a.
It must have legal personality and have its registered office in Switzerland.
b.
It must have appropriate expertise and the capacity to exercise its functions.
c.
It shall ensure the absence of any conflict of interest in carrying out its functions.
d.
It shall be accredited by the Swiss Accreditation Service (SAS) as a conformity assessment body that carries out inspections (Standard SN EN ISO/IEC 17020, 2012, Requirement for the operation of various types of bodies performing inspection, Type C3).

2 Inspection bodies shall apply for recognition; they shall submit the documents indicated in Annex 2 with their application. The FOEN is responsible for the recognition. It shall issue a specifications document setting out what technical competences inspection bodies must possess and what items must be checked during an inspection and recorded in a report.

3 If an inspection body no longer fulfils the requirements, the FOEN shall set a time limit by which the deficiency must be remedied. If the deficiency is not remedied within this time, the FOEN shall revoke the organisation's recognition and notify the SAS.

4 The SAS shall send the FOEN the reports that it produces in connection with the accreditation and continued accreditation of inspection bodies.

5 The FOEN shall keep a public list of recognised inspection bodies.

Art. 11 Riconoscimento

1 Un servizio di ispezione può essere riconosciuto se soddisfa i seguenti requisiti:

a.
deve essere dotato di personalità giuridica e avere sede in Svizzera;
b.
deve essere dotato delle necessarie competenze ed essere in grado di svolgere le proprie funzioni;
c.
garantisce l’assenza di conflitti di interesse nell’espletare le sue funzioni;
d.
dispone di un accreditamento del Servizio di accreditamento svizzero (SAS) quale organismo di certificazione della conformità che esegue ispezioni (norma SN EN ISO/IEC 17020: 2012, Requisiti per il funzionamento di vari tipi di organismi che eseguono ispezioni, tipo C3).

2 Il riconoscimento avviene su domanda, alla quale deve essere allegata la documentazione secondo l’allegato 2. La competenza per il riconoscimento è attribuita all’UFAM. Quest’ultimo emana un capitolato d’oneri in cui è indicato quali competenze tecniche devono possedere i servizi di ispezione e quali elementi vanno verificati e annotati in un rapporto nell’ambito di un’ispezione.

3 Se un servizio di ispezione non adempie più le condizioni, l’UFAM gli fissa un termine per colmare la lacuna. Se la lacuna non viene colmata entro tale termine, l’UFAM revoca l’accreditamento all’organismo e informa il SAS.

4 Il SAS invia all’UFAM i rapporti allestiti nell’ambito dell’accreditamento e del mantenimento dell’accreditamento dei servizi di ispezione.

5 L’UFAM tiene un elenco pubblico dei servizi di ispezione riconosciuti.
