Art. 37 Final report

1 The sponsor shall submit to the Ethics Committee a final report for clinical investigations in accordance with Section 2.8 of Chapter I and Section 7 of Chapter III of Annex XV to EU-MDR63 and for performance studies in accordance with Part A Section 2.3.3 of Annex XIII to EU-IVDR64:65

a.
within one year of the end of the clinical trial;
b.
within three months of the clinical trial being terminated early or interrupted.

2 If scientific reasons prevent compliance with the reporting deadline specified in paragraph 1 letter a, the sponsor must submit the report as soon as it is available. The clinical trial plan must specify when the final report is to be submitted and provide reasons.

3 A summary in easily understandable terms must be included with the final report.

Art. 37

1 Il promotore presenta alla commissione d’etica un rapporto finale conformemente all’allegato XV capo I punto 2.8 e capo III punto 7 UE-MDR62 per le indagini cliniche e conformemente all’allegato XIII parte A punto 2.3.3 UE-IVDR63 per gli studi delle prestazioni:64

a.
entro un anno dalla conclusione della sperimentazione clinica;
b.
entro tre mesi dall’arresto o dall’interruzione della sperimentazione clinica.

2 Se il termine entro il quale presentare il rapporto di cui al capoverso 1 lettera a non può essere rispettato per motivi scientifici, il promotore deve presentare il rapporto non appena è disponibile. Nel protocollo della sperimentazione deve essere riportato, indicandone la motivazione, quando verrà presentato il rapporto finale.

3 Al rapporto finale deve essere allegata una sintesi formulata in termini comprensibili a tutti.
