Art. 114

1 An action by a consumer relating to a contract which meets the requirements stated in Article 120 paragraph 1 may be brought at the consumer’s choice before the Swiss courts:

a.
at their domicile or habitual residence; or
b.
at the domicile or, in the absence of a domicile, at the habitual residence of the supplier.

2 A consumer cannot waive in advance jurisdiction at their domicile or habitual residence.

Art. 114

1 Dans les contrats qui répondent aux conditions énoncées par l’art. 120, al. 1, l’action intentée par un consommateur peut être portée, au choix de ce dernier, devant le tribunal suisse;

a.
de son domicile ou de sa résidence habituelle, ou
b.
du domicile ou, à défaut de domicile, de la résidence habituelle du fournisseur.

2 Le consommateur ne peut pas renoncer d’avance au for de son domicile ou de sa résidence habituelle.
