Any material changes in the actual circumstances described in the notification must be given immediately and voluntarily to the Secretariat. If these changes have a considerable effect on the assessment of a planned concentration, the Secretariat may decide prior to the opening of an investigation, or the Competition Commission may decide, after opening an investigation, that the period under Article 20 shall commence only on the day after the Secretariat receives the information on the material changes.
Les modifications essentielles des faits contenus dans la notification doivent être communiquées spontanément et sans délai au secrétariat. Lorsque ces modifications sont de nature à influer de manière significative sur l’évaluation de l’opération de concentration, le secrétariat ou la commission peut, le premier avant, la seconde après l’ouverture de la procédure d’examen, décider que le délai applicable selon l’art. 20 ne commencera à courir que le lendemain de la réception de la communication des modifications essentielles.
