The mandator may not plead as defence against the mandatee the fact that the payee did not have personal capacity to enter into the contract.
1 Lorsqu’une personne a reçu et accepté l’ordre d’ouvrir ou de renouveler, en son propre nom et pour son propre compte, un crédit à un tiers sous la responsabilité du mandant, celui-ci répond, comme une caution, de la dette du crédité, en tant que le créditeur n’a pas outrepassé son mandat.
2 Toutefois, le mandant n’encourt cette responsabilité que si l’ordre a été donné par écrit.
