Art. 98 Expert laboratories in Switzerland

1 Laboratories that wish to be designated an expert laboratory by the European Commission in accordance with Article 106 paragraph 7 EU-MDR131 may apply to Swissmedic for designation.

2 They must demonstrate to Swissmedic in particular that they:

a.
meet the criteria set out in Article 106 paragraph 8 EU-MDR; and
b.
are able to assume the tasks under Article 106 paragraph 10 EU-MDR, taking account of the amendments to this provision adopted by the European Commission by means of delegated acts132, in accordance with the requirements in each case.

3 They must operate in one of the following fields:

a.
physico-chemical characterisation;
b.
microbiological, mechanical, electrical, electronic or non-clinical biological and toxicological testing or biocompatibility testing.

4 If the requirements are met, Swissmedic shall propose to the European Commission that the laboratory be designated an expert laboratory.

Art. 98 Fachlaboratorien in der Schweiz

1 Laboratorien, die als ein von der Europäischen Kommission gemäss Artikel 106 Absatz 7 EU-MDR131 benanntes Fachlaboratorium tätig sein wollen, können bei der Swissmedic ein Gesuch einreichen.

2 Sie müssen der Swissmedic insbesondere belegen, dass sie:

a.
die Kriterien nach Artikel 106 Absatz 8 EU-MDR erfüllen; und
b.
in der Lage sind, nach Massgabe der jeweiligen Erfordernisse die Aufgaben nach Artikel 106 Absatz 10 EU-MDR, unter Berücksichtigung der Änderungen dieser Bestimmung, die von der Europäischen Kommission mittels delegierter Rechtsakte132 vorgenommen werden, zu übernehmen.

3 Sie müssen in einem der folgenden Gebiete tätig sein:

a.
physikalisch-chemische Charakterisierung;
b.
mikrobiologische, mechanische, elektrische, elektronische oder nichtklinische biologische und toxikologische Untersuchung oder Biokompatibilitätsuntersuchung.

4 Sind die Voraussetzungen erfüllt, so schlägt die Swissmedic der Europäischen Kommission das Laboratorium als Fachlaboratorium vor.
