Art. 23 Advisor on data protection

1 The Federal Chancellery and the Departments shall each appoint at least one advisor on data protection. This advisor has the following duties:

a.
advising the responsible bodies and users;
b.
encouraging the provision of information and the training of staff;
c.
participating in the implementation of the data protection regulations.

2 If federal bodies under Article 11a paragraph 5 letter e DPA wish to be exempted from the duty to register their data files, Articles12a and 12b apply.

3 The federal bodies consult with the Commissioner with regard to the advisor.

Art. 23 Berater für den Datenschutz

1 Die Bundeskanzlei und die Departemente bezeichnen jeweils mindestens einen Berater für den Datenschutz. Dieser Berater hat folgende Aufgaben:

a.
Unterstützung der verantwortlichen Organe und Benützer;
b.
Förderung der Information und der Ausbildung der Mitarbeiter;
c.
Mitwirkung beim Vollzug der Datenschutzvorschriften.

2 Wollen Bundesorgane nach Artikel 11a Absatz 5 Buchstabe e DSG von der Pflicht zur Anmeldung ihrer Datensammlungen befreit werden, so sind die Artikel 12a und 12b anwendbar.

3 Die Bundesorgane verkehren mit dem Beauftragten über den Berater.
