1 Erfüllt die Aufsichtsorganisation die Anforderungen nach dem 2. Kapitel dieses Titels nicht oder nimmt sie ihre Aufsichtsaufgaben nicht wahr, so ergreift die FINMA die erforderlichen Massnahmen.
2 Die FINMA kann Personen, welche die Gewähr für eine einwandfreie Geschäftstätigkeit nicht mehr erfüllen, abberufen.
3 Erweist sich keine andere Massnahme als wirkungsvoll, so kann die FINMA die Aufsichtsorganisation liquidieren und die Aufsichtstätigkeit auf eine andere Aufsichtsorganisation übertragen.
4 Bestehen Anzeichen für Missstände und sorgt die Aufsichtsorganisation nicht für die Wiederherstellung des rechtmässigen Zustands, so kann die FINMA:
1 The supervised persons and entities, their audit companies and auditors as well as persons or companies that are qualified investors or that have a substantial participation in the supervised persons and entities must provide FINMA with all information and documents that it requires to carry out its tasks.
2 The supervised persons and entities and the audit companies that conduct audits of them must also immediately report to FINMA any incident that is of substantial importance to the supervision.
