Art. 10 Widerruf von Covid-19-Zertifikaten

¹ Die Ausstellerinnen und Aussteller nach den Artikeln 6 und 7 sowie die zuständigen kantonalen Behörden widerrufen ein Covid-19-Zertifikat auf Antrag der Inhaberin oder des Inhabers, wenn diese oder dieser glaubhaft darlegt, dass:

a.: das Zertifikat falsche Angaben enthält; oder
b.: bei der Überprüfung der Authentizität, Gültigkeit oder Integrität des Zertifikats wiederholt Fehler aufgetreten sind.

² Ein Antrag auf Widerruf muss folgende Angaben enthalten:

a.: die eindeutige Zertifikatskennung;
b.: Angaben über die Identität der Inhaberin oder des Inhabers, soweit für die Beurteilung der Widerrufsgründe nach Absatz 1 erforderlich, sowie die weiteren für die Beurteilung der Widerrufsgründe erforderlichen Angaben.

³ Die Ausstellerinnen und Aussteller sind verpflichtet, die von ihnen ausgestellten Zertifikate, die nicht den Vorgaben dieser Verordnung entsprechen oder Tatsachen bezeugen, die sich als unzutreffend herausstellen, auch ohne Antrag unverzüglich zu widerrufen.

⁴ Das BIT und die zuständigen kantonalen Behörden widerrufen Zertifikate anstelle der Ausstellerin oder des Ausstellers, wenn diese oder dieser es nicht innert nützlicher Frist nach Absatz 1 oder 3 tut.

⁵ Die Ausstellerinnen und Aussteller und das BIT sowie die zuständigen kantonalen Behörden nehmen den Widerruf im System zur Ausstellung von Covid-19-Zertifikaten (Art. 26) vor. Dieses übermittelt die Kennungen der widerrufenen Zertifikate dem System zur Abfrage von widerrufenen Zertifikaten (Art. 27).

⁶ Die Ausstellerinnen und Aussteller, das BIT sowie die zuständigen kantonalen Behörden dokumentieren den Widerruf von Zertifikaten mit folgenden Informationen:

a.: eindeutige Zertifikatskennung;
b.: Angaben, welche die Nachvollziehbarkeit des Entscheides über den Widerruf ermöglichen.²³

Art. 10 Revocation of COVID-19 certificates

¹ The issuers specified in Articles 6 and 7 and the competent cantonal authorities shall revoke a COVID-19 certificate at the request of the holder if the holder credibly demonstrates that:

a.: the certificate contains incorrect information; or
b.: errors have repeatedly occurred when verifying the authenticity, validity or integrity of the certificate.

² A revocation request must contain the following:

a.: the unique certificate identifier;
b.: information on the identity of the holder, insofar as is necessary to assess the grounds for revocation in accordance with paragraph 1, as well as the further details required to assess the grounds for revocation.

³ Even in the absence of a request, issuers are obliged without delay to revoke the certificates they have issued which do not meet the requirements of this Ordinance or which attest to facts which turn out to be incorrect.

⁴ The FOITT and the competent cantonal authorities shall revoke certificates in the issuer's place if the issuer fails to do so within a reasonable period in accordance with paragraphs 1 or 3.

⁵ Issuers, the FOITT and the competent cantonal authorities shall revoke certificates in the system for issuing COVID-19 certificates (Art. 26), which shall transmit the identifiers of the revoked certificates to the system for retrieving revoked certificates (Art. 27).

⁶ Issuers, the FOITT and the competent cantonal authorities shall document the revocation of certificates with the following information:

a.: the unique certificate identifier;
b.: information that makes it clear why the decision to revoke the certificate was made.²³
