Art. 34 Beanstandete Produkte

¹ Haben die Vollzugsbehörden ein Produkt beanstandet, so ordnen sie die zur Wiederherstellung des gesetzlichen Zustandes erforderlichen Massnahmen an.

² Sie können anordnen, dass das beanstandete Produkt:

a.: mit oder ohne Auflagen verwertet werden darf;
b.: durch das Unternehmen auf dessen Kosten beseitigt werden muss;
c.: auf Kosten des Unternehmens eingezogen, unschädlich gemacht, unschädlich verwertet oder beseitigt werden muss.

³ Sie können die im Betrieb verantwortliche Person verpflichten:

a.: die Ursachen der Mängel abzuklären;
b.: geeignete Massnahmen zu treffen;
c.: die Vollzugsbehörden über die getroffenen Massnahmen zu informieren.

⁴ Werden Auflagen wiederholt missachtet, so können die Vollzugsbehörden die Beseitigung oder die Einziehung des Produkts anordnen.

⁵ Bei der Einfuhr können die Vollzugsbehörden ein beanstandetes Produkt auch:

a.: zurückweisen;
b.: an die zuständige kantonale Vollzugsbehörde für weitere Abklärungen überweisen;
c.: zurücksenden, wenn die für die Sendung verantwortliche Person und die zuständige Behörde des Herkunftslandes zustimmen;
d.: auf Antrag der für die Sendung verantwortlichen Person in ein neues Bestimmungsland senden, wenn die zuständige Behörde des Bestimmungslandes zustimmt.

Art. 34 Products in respect of which a complaint has been filed

¹ If the enforcement authorities have filed a complaint about a product, they shall order the measures required to restore it to its lawful state.

² They may order that the product complained of:

a.: may be used and whether such use is subject to conditions;
b.: must be disposed of by the company at its expense;
c.: must be confiscated, rendered harmless, recycled in a harmless manner or disposed of at the expense of the company.

³ They may require the responsible person at the business:

a.: to investigate the deficiencies;
b.: to take suitable measures;
c.: to inform the enforcement authorities of the measures taken.

⁴ If requirements are repeatedly disregarded, the enforcement authorities may order the disposal or the forfeiture of the product.

⁵ In relation to imports, the enforcement authorities may also order that a product complained of:

a.: be refused entry;
b.: be given to the competent cantonal enforcement authority for further testing;
c.: be sent back, provided the person responsible for shipping and the competent authority of the country of origin agree;
d.: be sent to a new country of destination at the request of the person responsible for shipping provided the competent authority of the country of destination agrees.
