Art. 10 Unabsichtliche grenzüberschreitende Verbreitung

1 Bei ausserordentlichen Ereignissen, die zu einer grenzüberschreitenden Verbreitung von gentechnisch veränderten Organismen führen können, benachrichtigen die betroffenen Kantone das BAFU und informieren die Bevölkerung, die Nachbarkantone und die zuständigen regionalen Behörden der Nachbarländer.

2 Das BAFU benachrichtigt die zuständigen nationalen Behörden der Nachbarländer.

3 Die Benachrichtigung der Behörden der Nachbarländer muss mindestens folgende Angaben enthalten:

a.
die geschätzte Menge sowie die wesentlichen Eigenschaften und Merkmale der gentechnisch veränderten Organismen;
b.
die Umstände und das Datum des Entweichens der gentechnisch veränderten Organismen sowie deren Verwendung;
c.
die möglichen Gefährdungen des Menschen, der Tiere oder der Umwelt und die Beeinträchtigungen der biologischen Vielfalt und deren nachhaltiger Nutzung;
d.
mögliche Massnahmen zur Bewältigung des Risikos.

4 Bei ausserordentlichen Ereignissen in Betrieben nach Artikel 1 Absatz 2 Buchstabe b und Absatz 3 Buchstabe b der Störfallverordnung vom 27. Februar 199119 gelten zusätzlich deren Vorschriften über die Information und Alarmierung.

5 Das BAFU nimmt die ausländischen Benachrichtigungen entgegen und informiert die betroffenen Kantone. Diese informieren die Bevölkerung in geeigneter Weise.

Art. 10 Measures to be taken in the event of unintentional transboundary movements

In the case of an extraordinary event that may result in a transboundary movement of genetically modified organisms, the cantons concerned notify the FOEN and inform the public, neighbouring cantons and the relevant regional authorities in neighbouring countries.

The FOEN shall notify the relevant national authorities of neighbouring countries about such events.

The formal notification of the authorities of neighbouring countries must contain the following information as a minimum:

a.
the properties and characteristics of the genetically modified organisms and the estimated quantities involved;
b.
the date of the release and the circumstances as well as the use made of the genetically modified organisms in question;
c.
the potential dangers to humans, animals and the environment as well as the potential risks to biological diversity and to its sustainable use;
d.
possible risk management measures.

In the case of an extraordinary event in an establishment in terms of Article 1 paragraph 2 letter b and paragraph 3 letter b of the Ordinance on Protection against Major Accidents of 27 February 199118, the provisions of this Ordinance relating to information and giving the alert are also applicable.

The FOEN registers notifications from abroad and inform the cantons concerned. The latter informs the public in the appropriate manner.
