1 Die für den Vollzug dieser Verordnung zuständigen Behörden behandeln die Angaben, an deren Geheimhaltung ein überwiegendes schutzwürdiges Interesse besteht, vertraulich. Sie bezeichnen diese Angaben bei einer allfälligen Weitergabe an andere Behörden.
2 Wer den Behörden Gesuchsunterlagen einreicht, muss:
3 Will eine Behörde Angaben, deren Geheimhaltung verlangt wird, nicht vertraulich behandeln, so prüft sie, ob das geltend gemachte Geheimhaltungsinteresse schutzwürdig ist. Weicht ihre Beurteilung vom Antrag der Auskunftgeberin oder des Auskunftgebers ab, so teilt sie dieser oder diesem nach vorgängiger Anhörung durch Verfügung mit, bezüglich welcher Angaben sie kein schutzwürdiges Interesse anerkennt.

If its assessment differs from the proposal of the persons supplying the information, the authority, after hearing these persons, shall inform them in a ruling which information they do not find worthy of protection.
