Art. 7 Fernabsatz

¹ Produkte, die in der Schweiz über eine Dienstleistung der Informationsgesellschaft angeboten werden, namentlich über einen Online-Dienst, der die Bedingungen nach Absatz 5 erfüllt, müssen den Anforderungen dieser Verordnung entsprechen.

² Produkte, die Anwenderinnen und Anwendern in der Schweiz online oder über eine andere Form des Fernabsatzes angeboten werden, gelten als auf dem Markt bereitgestellt.

³ Ebenso dieser Verordnung entsprechen müssen Produkte, die zwar nicht in Verkehr gebracht, aber im Rahmen einer gewerblichen Tätigkeit gegen Entgelt oder unentgeltlich eingesetzt werden zur Erbringung diagnostischer oder therapeutischer Dienstleistungen, die über eine Dienstleistung der Informationsgesellschaft oder über andere Kommunikationskanäle angeboten werden.

⁴ Wer ein Produkt nach Absatz 1 anbietet oder diagnostische oder therapeutische Dienstleistungen nach Absatz 3 erbringt, muss der Swissmedic auf Verlangen eine Kopie der Konformitätserklärung vorlegen.

⁵ Ein Produkt gilt als über eine Dienstleistung der Informationsgesellschaft angeboten, wenn die Dienstleistung:

a.: im Fernabsatz erbracht ist, nämlich ohne gleichzeitige physische Anwesenheit der Vertragsparteien;
b.: elektronisch erfolgt; und
c.: auf individuelle Anforderung der Empfängerin oder des Empfängers oder ihres oder seines Vertreters erfolgt.

Art. 7 Distance sales

¹ Devices offered in Switzerland by means of information society services – specifically an online service – that fulfil the conditions set out in paragraph 5 must comply with this Ordinance.

²Devices offered to users in Switzerland online or via some other form of distance sales are considered to have been made available on the market.

³ Similarly, devices although not placed on the market, but used in the context of a commercial activity, whether in return for payment or free of charge, for the provision of a diagnostic or therapeutic service offered by means of information society services or by other means of communication shall also comply with this Ordinance.

⁴ Upon request by the Swiss Agency for Therapeutic Products (Swissmedic), any natural or legal person offering diagnostic or therapeutic services in accordance with paragraph 1 shall make available a copy of the declaration of conformity.

⁵ A device is deemed to be supplied via an information society service if that service:

a.: is provided by distance selling, specifically without the contracting parties being physically present at the same time;
b.: is provided electronically; and
c.: is provided at the individual request of the recipient or the recipient’s representative.
