272 Swiss Civil Procedure Code of 19 December 2008 (Civil Procedure Code, CPC)
Art. 10 Wohnsitz und Sitz
1 Sieht dieses Gesetz nichts anderes vor, so ist zuständig:
- a.
- für Klagen gegen eine natürliche Person: das Gericht an deren Wohnsitz;
- b.
- für Klagen gegen eine juristische Person und gegen öffentlich-rechtliche Anstalten und Körperschaften sowie gegen Kollektiv- und Kommanditgesellschaften: das Gericht an deren Sitz;
- c.
- für Klagen gegen den Bund: das Obergericht des Kantons Bern oder das obere Gericht des Kantons, in dem die klagende Partei ihren Wohnsitz, Sitz oder gewöhnlichen Aufenthalt hat;
- d.
- für Klagen gegen einen Kanton: ein Gericht am Kantonshauptort.
2 Der Wohnsitz bestimmt sich nach dem Zivilgesetzbuch (ZGB)18. Artikel 24 ZGB ist nicht anwendbar.
Art. 10 Domicile and registered office
1 Unless this Code provides otherwise, the following court has jurisdiction:
- a.
- for actions against a natural person: the court at the person's domicile;
- b.
- for actions against legal entities, public corporations and institutions as well as general partnerships and limited partnerships: the court at the location of their registered office;
- c.
- for actions against the Confederation: the Supreme Court of the Canton of Bern or the supreme court of the canton where the plaintiff's domicile, registered office or habitual residence is located;
- d.
- for actions against a canton: a court in the canton's capital.
2 Domicile is determined in accordance with the Civil Code (CC)18. Article 24 CC does not apply.
