1 Die Luftverkehrsunternehmen müssen auf Verlangen der zuständigen Behörden des Bundes oder der Kantone die von ihnen beförderten Personen, denen die Einreise in den Schengen-Raum verweigert wird, unverzüglich betreuen.
2 Die Betreuungspflicht umfasst:
3 Kann ein Luftverkehrsunternehmen nicht nachweisen, dass es seiner Sorgfaltspflicht nachgekommen ist, so muss es zusätzlich übernehmen:
4 Absatz 3 findet keine Anwendung, wenn der beförderten Person die Einreise in die Schweiz nach Artikel 22 AsylG292 bewilligt wurde. Der Bundesrat kann weitere Ausnahmen vorsehen, insbesondere für Ausnahmesituationen wie Krieg oder Naturkatastrophen.293
5 Der Bundesrat kann auf der Grundlage der voraussichtlichen Aufwendungen eine Pauschale festlegen.
6 Es können Sicherheiten verlangt werden.

3 If the air carrier is unable to provide evidence that it has fulfilled its duty of care, it must additionally bear:
4 Paragraph 3 does not apply if the person being transported has been granted entry to Switzerland in terms of Article 22 AsylA292. The Federal Council may provide for further exceptions, in particular for exceptional circumstances such as war or natural disasters.293
5 The Federal Council may stipulate a flat-rate charge based on the expected costs.
6 It may request security for the payment of costs.
