II. Insolvency of the partnership
1 The partnership’s creditors are entitled to satisfaction from the partnership’s assets to the exclusion of the personal creditors of the indivaidual partners.
2 Limited partners have no claim as creditors in insolvency for their specific capital contributions.
E. Situation des créanciers personnels
1 Les créanciers personnels d’un associé indéfiniment responsable ou d’un commanditaire n’ont, pour se faire payer ou pour obtenir des sûretés, aucun droit sur l’actif social.
2 Ils n’ont droit, dans la procédure d’exécution, qu’aux intérêts, aux bénéfices et à la part de liquidation revenant à leur débiteur en sa qualité d’associé, ainsi qu’aux honoraires qui pourraient lui être attribués.
