d. Statement of commission

¹ Where the agent is not obliged by written agreement to draw up a statement of commission, the principal must provide him with a written statement as at each due date indicating the transactions on which commission is payable.

² On request, the agent must be granted access to the books of account or supporting documents that are relevant to such statement. The agent may not waive this right in advance.

b. Extinction du droit à la provision

¹ L’agent perd son droit à la provision dans la mesure où l’exécution d’une affaire conclue est empêchée par une cause non imputable au mandant.

² Ce droit s’éteint en revanche si la contre-prestation correspondant à la prestation déjà effectuée par le mandant n’est pas accomplie ou l’est si peu que le paiement d’une provision ne saurait être exigé du mandant.
