II. Powers
1. In general
1 The representative has such powers as are conferred on him by law, the bond issue conditions or the creditors’ meeting.
2 His duties are to request that the borrower convene a creditors’ meeting where the conditions for such convocation obtain, to implement its resolutions and to represent the community of creditors within the bounds of the powers conferred on him.
3 To the extent that the representative is authorised to assert the creditors’ rights, the indivaidual creditors are not entitled to exercise their rights independently.
3. Effets de l’acceptation
1 Lorsqu’une assignation à ordre est acceptée de plein gré, l’auteur de l’acceptation est assimilé à l’accepteur d’une lettre de change.
2 Le porteur ne peut cependant exercer son recours avant l’échéance si l’assigné est en faillite, a suspendu ses paiements ou a été l’objet d’une saisie infructueuse.
3 De même, il n’y a pas de recours avant l’échéance lorsque l’assignant est en faillite.
