161.1 Federal Act of 17 December 1976 on Political Rights

Art. 38 Cedels electorals nunvalaivels e vuschs da candidat nunvalaivlas

1 Cedels electorals èn nunvalaivels, sch’els:

a.
na cuntegnan nagin num d’ina candidata u d’in candidat dal circul electoral;
b.
n’èn betg uffizials;
c.
èn vegnids emplenids u midads auter che a maun;
d.
cuntegnan remartgas ingiuriusas u èn marcads cun segns evidents;
e.70

2 Dal cedel electoral vegnan stritgadas:

a.
repetiziuns da memia, sch’il num d’ina candidata u d’in candidat figurescha dapli che duas giadas sin in cedel electoral;
b.
tuts ils nums da persunas, da las qualas la candidatura è vegnida annullada pervia d’ina candidatura multipla suenter la rectificaziun da las propostas electoralas.71

3 Sch’in cedel electoral cuntegna dapli nums che quai ch’i èn avant maun sezs, vegnan stritgads ils ultims nums prestampads che n’èn betg cumulads a maun, e suenter ils ultims nums agiuntads a maun.72

4 Resalvads restan ils motivs da nunvalaivladad e da nullitad che resultan da la procedura chantunala (cuverta da votar, bul da controlla e.u.v.).73

5 Il dretg d’in chantun che realisescha emprovas cun la votaziun electronica definescha las premissas per la votaziun valaivla ed ils motivs da nunvalaivladad.74

Art. 38 Invalid ballot papers and candidate votes

1 Ballot papers are invalid if they:

a.
do not contain the name of a candidate standing in the constituency;
b.
are not official;
c.
have been completed or altered other than by hand;
d.
contain defamatory remarks or obviously irrelevant markings;
e.70

2 The following shall be deleted from the ballot paper:

a.
superfluous repetitions if the name of a candidate appears more than twice on a ballot paper;
b.
all names of persons whose candidacies were declared invalid due to multiple candidacy following the rectification of the candidate lists.71

3 If the ballot paper contains more names than there are seats to be allocated, the last pre-printed names on the list that have not been accumulated by hand shall be deleted followed by the last names that have been added by hand.72

4 Grounds for invalidity or nullity that relate to the cantonal procedure (official voting envelope or validation stamp, etc.) remain reserved.73

5 In the case of electronic voting pilot schemes, the legislation of each canton conducting such a scheme determines the requirements according to which votes are validly cast and the grounds for invalidity.74
