1 Chiunque intenzionalmente procura a sé stesso o a terzi un profitto fiscale illecito, segnatamente sottrae la tassa o ottiene illecitamente un’esenzione, un abbuono o una restituzione della tassa, è punito con la multa sino al triplo del valore del profitto illecito.
2 Il tentativo e la complicità sono punibili.
3 Chiunque, per negligenza, ottiene per sé stesso o per terzi un profitto fiscale illecito, è punito con la multa sino al valore del profitto illecito.
1 Any person who wilfully obtains for himself or for another an unlawful advantage with regard to the levy , in particular by evading the CO2 levy or by obtaining an unlawful exemption from or distribution or refund of the levy, shall be liable to a fine not exceeding three times the amount of the unlawful advantage.
2 Attempts and complicity are offences.
3 Any person who obtains for himself or for another an unlawful advantage with regard to the levy through negligence shall be liable to a fine not exceeding the amount of the unlawful advantage.
