Art. 210 Proposta di giudizio

1 L’autorità di conciliazione può sottoporre alle parti una proposta di giudizio:

a.
nelle controversie secondo la legge federale del 24 marzo 199578 sulla parità dei sessi;
b.
nelle controversie in materia di locazione e affitto di abitazioni e di locali commerciali come pure di affitto agricolo, se vertenti sul deposito di pigioni o fitti, sulla protezione da pigioni o fitti abusivi, sulla protezione dalla disdetta o sulla protrazione del rapporto di locazione o d’affitto;
c.
nelle altre controversie patrimoniali fino a un valore litigioso di 5000 franchi.

2 La proposta di giudizio può contenere una breve motivazione; per il resto si applica per analogia l’articolo 238.

Art. 211 Effects

1 The proposed judgment is deemed to be accepted and has the effect of a binding decision if none of the parties rejects it within 20 days of written notification to the parties. The rejection needs no statement of grounds.

2 After receiving the rejection, the conciliation authority shall grant authorisation to proceed:

a.
to the rejecting party in matters under Article 210 paragraph 1 letter b;
b.
to the plaintiff in all other cases.

3 If in matters under Article 210 paragraph 1 letter b the action is not filed in time, the proposed judgment is deemed to be accepted and has the effect of a binding decision.

4 The parties must be advised in the proposed judgment of its effects in accordance with paragraphs 1 to 3 above.
