1 Vi è inosservanza di un termine quando una parte non compie tempestivamente un atto processuale oppure, benché citata, non compare.
2 Salvo che la legge disponga altrimenti, la procedura continua il suo corso senza l’atto processuale così omesso.
3 Il giudice rende attente le parti alle conseguenze dell’inosservanza di un termine.
1 The court may on application grant a period of grace or summon the parties again for a new appearance provided the defaulting party shows credibly that he or she was not responsible for the default or was responsible only to a minor extent.
2 The application must be submitted within 10 days of the day when the cause of default has ceased to apply.
3 If notice of a decision has been given to the parties, restitution may be requested only within six months after the decision has come into force.
