Le sostanze o le miscele di sostanze che come tali sono comprese nello stato della tecnica, eccetto per quanto concerne la loro utilizzazione in un metodo per il trattamento chirurgico o terapeutico o in un metodo di diagnosi di cui all’articolo 2 capoverso 2 lettera a24 laddove tale utilizzazione risulti specifica rispetto all’indicazione medica primaria giusta l’articolo 7c, sono considerate nuove nella misura in cui sono destinate unicamente alla fabbricazione di un prodotto a scopi chirurgici, terapeutici o diagnostici.

Any substance or composition that forms part of the state of the art as such, but not in relation to a specific use in a surgical, therapeutic or diagnostic method specified in Article 2 paragraph 2 letter a26 that is distinct from the first medical use specified in Article 7c is deemed to be new provided it is intended for use in the manufacture of a means to a surgical, therapeutic or diagnostic end.
