Art. 10 Mesures en cas de mouvements transfrontières non intentionnels

1 En cas d’événement extraordinaire pouvant entraîner un mouvement transfrontière d’organismes génétiquement modifiés, les cantons concernés notifient cet événement à l’OFEV et informent la population, les cantons voisins et les autorités régionales compétentes des pays voisins.

2 L’OFEV notifie l’incident aux autorités nationales compétentes des pays voisins.

3 La notification adressée aux autorités des pays voisins doit contenir au minimum les informations suivantes:

a.
les quantités estimées et les traits et caractéristiques des organismes génétiquement modifiés;
b.
les circonstances et la date de la dissémination ainsi que l’utilisation des organismes génétiquement modifiés;
c.
les dangers potentiels pour l’être humain, les animaux et l’environnement ainsi que les atteintes potentielles à la diversité biologique et à l’utilisation durable de ses éléments;
d.
les mesures possibles de gestion des risques.

4 En cas d’événement extraordinaire dans des installations au sens de l’art. 1, al. 2, let. b, et al. 3, let. b, de l’ordonnance du 27 février 1991 sur les accidents majeurs19, les dispositions de cette ordonnance relatives à l’information et à l’alarme sont également applicables.

5 L’OFEV enregistre les notifications en provenance de l’étranger et informe les cantons concernés. Ceux-ci informent la population de manière appropriée.

Art. 10 Measures to be taken in the event of unintentional transboundary movements

1 In the case of an extraordinary event that may result in a transboundary movement of genetically modified organisms, the cantons concerned notify the FOEN and inform the public, neighbouring cantons and the relevant regional authorities in neighbouring countries.

2 The FOEN shall notify the relevant national authorities of neighbouring countries about such events.

3 The formal notification of the authorities of neighbouring countries must contain the following information as a minimum:

a.
the properties and characteristics of the genetically modified organisms and the estimated quantities involved;
b.
the date of the release and the circumstances as well as the use made of the genetically modified organisms in question;
c.
the potential dangers to humans, animals and the environment as well as the potential risks to biological diversity and to its sustainable use;
d.
possible risk management measures.

4 In the case of an extraordinary event in an establishment in terms of Article 1 paragraph 2 letter b and paragraph 3 letter b of the Ordinance on Protection against Major Accidents of 27 February 199118, the provisions of this Ordinance relating to information and giving the alert are also applicable.

5 The FOEN registers notifications from abroad and inform the cantons concerned. The latter informs the public in the appropriate manner.
