Art. 6 Protection de l’être humain, des animaux, de l’environnement et de la diversité biologique

¹ Quiconque utilise des organismes génétiquement modifiés doit veiller à ce que ces organismes, leurs métabolites et leurs déchets:

a.: ne puissent mettre en danger l’être humain, les animaux ou l’environnement;
b.: ne portent pas atteinte à la diversité biologique ni à l’utilisation durable de ses éléments.

² La dissémination expérimentale d’organismes génétiquement modifiés est autorisée à condition que:

a.: les résultats recherchés ne puissent être obtenus par des essais réalisés en milieu confiné;
b.: la dissémination apporte également une contribution à l’étude de la biosécurité des organismes génétiquement modifiés;
c.: ces organismes ne contiennent pas de gènes introduits par génie génétique qui induisent une résistance aux antibiotiques utilisés en médecine humaine et vétérinaire;
d.: d’après les connaissances scientifiques les plus récentes, la propagation de ces organismes et de leurs nouvelles propriétés dans l’environnement soit exclue et que les principes visés à l’al. 1 ne puissent être violés d’aucune autre manière.

³ La mise en circulation d’organismes génétiquement modifiés destinés à être utilisés dans l’environnement n’est autorisée que si ces organismes ne contiennent pas de gènes introduits par génie génétique qui induisent une résistance aux antibiotiques utilisés en médecine humaine et vétérinaire et si des essais en milieu confiné et des disséminations expérimentales ont établi que ces organismes:

a.: ne portent pas atteinte à une population d’organismes protégés ou importants pour l’écosystème concerné;
b.: ne provoquent pas la disparition non voulue d’une espèce d’organismes;
c.: ne perturbent pas gravement ou à long terme l’équilibre des composantes de l’environnement;
d.: ne portent pas atteinte, gravement ou à long terme, à des fonctions importantes de l’écosystème concerné, en particulier à la fertilité du sol;
e.: ne se propagent pas ni ne propagent leurs propriétés de manière indésirable;
f.: ne contreviennent pas d’une autre manière aux principes visés à l’al. 1.

⁴ Les dangers et les atteintes sont évalués tant isolément que collectivement et dans leurs effets cumulés; il est également tenu compte des relations avec d’autres dangers et atteintes non liés aux organismes génétiquement modifiés.

Art. 6 Protection of human beings, animals, environment and biological diversity

¹ Genetically modified organisms may only be handled in such a way that they, their metabolic products or wastes:

a.: cannot endanger human beings, animals or the environment;
b.: do not harm biological diversity or the sustainable use thereof.

² Genetically modified organisms may be released for experimental purposes if:

a.: the information sought cannot be obtained through experiments in contained systems;
b.: the experiment also contributes to research on the biosafety of genetically modified organisms;
c.: they do not contain genes inserted by gene technology which cause resistance to antibiotics used in human or veterinary medicine; and
d.: according to the current state of knowledge, the dispersal of these organisms and their new traits can be excluded and the principles of paragraph 1 cannot otherwise be contravened.

³ Genetically modified organisms lawfully intended for use in the environment may only be put into circulation if they do not contain gene technologically inserted resistance genes to antibiotics used in human or veterinary medicine, and if experiments in contained systems and field trials have shown that they:

a.: do not harm the population of protected organisms or organisms that are important for the ecosystem in question;
b.: do not lead to the unintended extinction of a species of organism;
c.: do not severely or permanently harm the material balance of the environment;
d.: do not severely or permanently harm any important functions of the ecosystem in question, and in particular the fertility of the soil;
e.: do not disperse or spread their traits in an undesired way; and
f.: do not otherwise contravene the principles of paragraph 1.

⁴ Hazards and harm must be evaluated both individually and as a whole and in terms of their interaction; connections to other hazards and harm from causes other than genetically modified organisms should also be considered.
