1 Quiconque souhaite mettre ou remettre en service un ouvrage d’accumulation doit être titulaire d’une autorisation délivrée par l’autorité de surveillance.
2 La demande d’autorisation doit comporter toutes les indications requises pour l’évaluation de la sécurité technique.
3 L’autorité de surveillance examine les indications fournies par la partie requérante et contrôle si les exigences de sécurité technique sont respectées. Dans la mesure où la sécurité technique de l’installation l’exige, elle fixe des conditions pour la mise en service et l’exploitation.
1 In order for a water retaining facility to be commissioned or recommissioned, a licence must be obtained from the supervisory authority.
2 Applications for a licence must include all the information required to carry out a technical safety assessment.
3 The supervisory authority examines the information provided by the applicant and verifies whether the technical safety requirements are complied with. If deemed necessary to ensure the technical safety of the installation, the supervisory authority shall specify conditions concerning its commissioning and its operation.
