1 Le droit à la délivrance du brevet et le droit au brevet passent aux héritiers; ils peuvent être transférés à des tiers, en tout ou en partie.
2 Lorsque ces droits appartiennent à plusieurs, chaque ayant droit ne peut les exercer qu’avec le consentement des autres; chacun peut cependant, de façon indépendante, disposer de sa part et intenter action pour violation du brevet.
2bis Le transfert de la demande de brevet et du brevet qui découle d’un acte juridique n’est valable que sous la forme écrite.77
3 Le transfert du brevet s’opère indépendamment de son inscription au registre des brevets; à défaut d’inscription, les actions prévues par la présente loi pourront cependant être dirigées contre l’ancien titulaire du brevet.
4 Les droits des tiers non inscrits au registre des brevets ne sont pas opposables à celui qui, de bonne foi, acquiert des droits sur le brevet.

2 Where the said rights are owned by two or more persons, each entitled person may exercise the rights only with the consent of the others; however, each one may independently dispose of his part or bring an action for infringement of the patent.
2bis The transfer of a patent application and of the patent by legal act is valid only if evidenced in writing.78
3 A patent may be transferred without the transfer being recorded in the Patent Register; however, until an entry is made, any action provided for in this Act may be taken against the former proprietor of the patent.
4 Rights of third parties not recorded in the Patent Register are invalid against persons who have acquired the rights to the patent in good faith.
