Art. 5 Entitlement to submit an application for registration

¹ Any group of producers that is representative of a product may submit an application for registration to the Federal Office for Agriculture (FOAG).

² In the case of agricultural products and processed agricultural products, a group is deemed to be representative where:

a.: its members produce, process and refine at least half of the production volume of the product;
b.: at least 60% of the producers, 60% of the processors and 60% of the refiners of the product are members thereof; and
c.: they show that the group is organised on the basis of democratic principles.

³ In the case of plant products and processed plant products, only farmers producing a significant quantity of the raw material shall be taken into account in calculating the 60% referred to in paragraph 2 letter b.

⁴ In the case of forestry products and processed forestry products, a group is deemed to be representative where:

a.: its members produce, process and refine at least half the production volume of the product;
b.: its members represent at least 60% of the forest area and 60% of the processors; and
c.: they show that the group is organised on the basis of democratic principles.

⁵ In the case of designations of origin, the group must comprise producers from all production stages, and specifically for each product:

a.: those that produce the raw materials;
b.: those that process the product;
c.: those that refine it.

Art. 5 Diritto di presentare la domanda

¹ Ogni raggruppamento di produttori rappresentativo di un prodotto può presentare all’Ufficio federale dell’agricoltura (UFAG) una domanda di registrazione.

² Per i prodotti agricoli e i prodotti agricoli trasformati, un raggruppamento è considerato rappresentativo se:

a.: i suoi membri producono, trasformano o elaborano almeno la metà del volume del prodotto;
b.: almeno il 60 per cento dei produttori, il 60 per cento dei trasformatori e il 60 per cento degli elaboratori del prodotto ne sono membri; e
c.: fornisce la prova di essere organizzato secondo principi democratici.

³ Per i prodotti vegetali e i prodotti vegetali trasformati, nel calcolo del 60 per cento in virtù del capoverso 2 lettera b sono considerati soltanto i gestori che producono una ingente quantità della materia prima.

⁴ Per i prodotti silvicoli e i prodotti silvicoli trasformati, un raggruppamento è considerato rappresentativo se:

a.: i suoi membri producono, trasformano o elaborano almeno la metà del volume del prodotto;
b.: i suoi membri rappresentano almeno il 60 per cento della superficie forestale e il 60 per cento dei trasformatori; e
c.: fornisce la prova di essere organizzato secondo principi democratici.

⁵ Per una denominazione di origine, il raggruppamento deve riunire i produttori di tutte le fasi di produzione, vale a dire, a seconda del prodotto:

a.: quelli che producono la materia prima;
b.: quelli che trasformano il prodotto;
c.: quelli che elaborano il prodotto.
