814.01 Legge federale del 7 ottobre 1983 sulla protezione dell'ambiente (Legge sulla protezione dell'ambiente, LPAmb)
Art. 59b Guarantee
For the protection of injured parties, the Federal Council may:
- a.146
- require that the operators of certain establishments or installations as well as the persons required to obtain authorisation or file a report that handle pathogenic organisms to provide a guarantee for their potential liability through insurance or in another manner;
- b.
- determine the extent and the duration of this guarantee or leave this to the authority to decide on a case-by-case basis;
- c.
- require those providing a guarantee for liability to notify the enforcement authority of the existence, suspension and termination of the guarantee;
- d.
- provide that the guarantee must not be suspended or terminated until 60 days after receipt of the notification;
- e.
- provide that land on which a waste disposal site is situated becomes the property of the canton when the site is closed, and enact regulations concerning any compensation.
Art. 59b Garanzia
Allo scopo di proteggere il danneggiato, il Consiglio federale può:
- a.148
- prescrivere che i titolari di determinati impianti o aziende e le persone soggette all’obbligo d’autorizzazione o di notifica che utilizzano organismi forniscano garanzie, sotto forma di assicurazione o in altro modo, per coprire la loro responsabilità civile;
- b.
- fissare l’entità e la durata di tale garanzia oppure lasciare che sia l’autorità a decidere di caso in caso;
- c.
- obbligare chi si porta garante della responsabilità civile a notificare all’autorità esecutiva l’esistenza, la sospensione o la cessazione della garanzia;
- d.
- prevedere che la garanzia sia sospesa o cessi soltanto 60 giorni dopo il ricevimento della notifica;
- e.
- prevedere che la chiusura della discarica comporti il trasferimento al Cantone della proprietà del fondo sul quale la discarica è situata e regolare la questione dell’indennizzo.
