Art. 44 Reassessment of substances, preparations and objects

Manufacturers must reassess or further assess substances, preparations and objects containing dangerous constituents and, where necessary, reclassify, relabel and repackage them if:

a.: they are to be supplied for different purposes;
b.: they are to be used in a different way;
c.: they are to be used in much larger quantities than before;
d.: variations arise in the nature and quantity of impurities, which could have adverse effects on human health or the environment;
e.: the assessment of the risks they pose to human health or the environment needs to be modified in the light of practical experience, new data or new information.

Art. 44 Nuova valutazione di sostanze, preparati e oggetti

Il fabbricante deve procedere a una nuova valutazione delle sostanze, dei preparati e degli oggetti contenenti sostanze pericolose o completare quella esistente e, se del caso, a classificarli, etichettarli e imballarli nuovamente se:

a.: si intende fornirli per un altro scopo;
b.: si intende impiegarli in altro modo;
c.: si intende impiegarli in quantità sensibilmente maggiori rispetto al passato;
d.: nella natura e nella quantità delle impurezze sorgono differenze tali da poter influire negativamente sull’essere umano o sull’ambiente;
e.: in base alle esperienze maturate nella prassi, a nuovi dati o a nuove conoscenze, la pericolosità per l’essere umano o la compatibilità con l’ambiente deve essere valutata altrimenti.
