Art. 37 Review of the notification or declaration

¹ The assessment authorities, within their area of competence, shall assess whether:

a.: the submission is complete or if not, whether the reasons given by the notifier are valid;
b.: the data is scientifically plausible;
c.: the test reports are based on tests meeting the requirements specified in Article 43.

² If, when reviewing the notification dossier, an assessment authority determines that a substance poses a particular risk for human health or the environment, on account of its dangerous nature, its properties, its foreseeable use or the quantity placed on the market, the authority may conduct a targeted risk assessment before accepting the notification.

³ The assessment authorities shall report the results of their review to the Notification Authority.

Art. 37 Verifica della notifica o della comunicazione

¹ I servizi di valutazione verificano nella loro sfera di competenze se:

a.: la documentazione è completa o, in caso contrario, se i motivi addotti dal notificante sono validi;
b.: le indicazioni sono scientificamente plausibili;
c.: i rapporti d’esame si fondano su esami che adempiono i requisiti di cui all’articolo 43.

² Se, alla verifica della documentazione di notifica, un servizio di valutazione constata che la sostanza costituisce un rischio particolare per la salute dell’essere umano o per l’ambiente a causa della sua pericolosità, delle sue proprietà, del suo presunto impiego o delle quantità immesse sul mercato, può eseguire una valutazione mirata dei rischi prima dell’accettazione della notifica.

³ I servizi di valutazione comunicano all’organo di notifica il risultato della loro verifica.
