Art. 12 Exemptions from liability

Any person who proves that:

a.
the damage is only slight and temporary; and
b.
the extent of the damage is no greater than would be expected in the current state of scientific knowledge

shall be exempt from liability under Article 19 paragraph 1 HRA.

Art. 12 Deroghe alla responsabilità civile

È esonerato dalla responsabilità civile conformemente all’articolo 19 capoverso 1 LRUm chi prova che il danno:

a.
ha soltanto effetti di lieve entità ed è temporaneo; e
b.
non supera la misura presumibile secondo lo stato della scienza.
