Art. 20 Recording and retention of programmes and contributions as part of the other journalistic services from SRG SSR

1 Broadcasters of Swiss programme services must record all programmes and keep the recordings and the relevant material and documentation for at least four months. The Federal Council may exempt certain categories of broadcasters from this obligation.

2 Contributions as part of the other journalistic services from SRG SSR must also be recorded and retained with the relevant material and documentation. The Federal Council shall regulate the duration and extent of the recording and retention obligation, taking account of technical feasibility and what can reasonably be expected of SRG SSR.

3 If a complaint is submitted to the Ombudsman Service within the retention period or an objection is raised with the Independent Complaints Authority for Radio and Television or an official supervisory procedure is opened, the recordings, materials and documentation must be retained until the completion of the proceedings.

Art. 20 Registrazione e conservazione delle trasmissioni e dei contributi che compongono l’ulteriore offerta editoriale della SSR

1 Le emittenti di programmi svizzeri devono registrare tutte le trasmissioni e conservare le registrazioni, unitamente ai relativi materiali e documenti, per almeno quattro mesi. Il Consiglio federale può esonerare talune categorie di emittenti da tale obbligo.

2 I contributi che compongono l’ulteriore offerta editoriale della SSR vanno anch’essi registrati e conservati, unitamente ai relativi materiali e documenti. Il Consiglio federale disciplina la durata e la portata dell’obbligo di registrazione e di conservazione in funzione delle possibilità tecniche e di quanto può essere ragionevolmente preteso dalla SSR.

3 Se, durante il periodo di conservazione, è presentato reclamo presso l’organo di mediazione o è interposto ricorso presso l’Autorità indipendente di ricorso in materia radiotelevisiva oppure è aperto d’ufficio un procedimento di vigilanza, le registrazioni, i materiali e i documenti relativi devono essere conservati sino al termine del procedimento.
