1 In the event that the payments by a fund in favour of a beneficiary should exceed its entitlement, the beneficiary shall repay the difference to the fund, together with interest at normal market rates.
2 If the beneficiary is unable to effect repayment within a period specified by the Federal Council, the other contributing parties and beneficiaries of the fund concerned shall cover the difference through additional payments in proportion to their contributions.
3 An obligation to pay additional contributions shall also apply:
4 In the event that additional payments to cover shortages of funds should be deemed unreasonable by the parties concerned, the Federal Assembly shall decide whether, and to what extent, the Confederation shall contribute towards the uncovered costs.
1 Se la pretesa del contributore non è sufficiente per coprire i costi, egli copre la differenza con i propri mezzi.
2 Se il contributore prova che i propri mezzi non sono sufficienti, il fondo di disattivazione o il fondo di smaltimento copre i costi rimanenti con la totalità dei mezzi. Lo stesso vale anche nel caso dell’articolo 78 capoverso 4.
3 Il fondo di smaltimento copre i costi che risultano per la Confederazione in seguito alle prestazioni per lo smaltimento secondo l’articolo 33 capoverso 1 lettera b, mediante i contributi che la persona tenuta allo smaltimento ha versato al fondo. Se questi contributi non sono sufficienti, il fondo copre i costi rimanenti con la totalità dei suoi mezzi.
