1 The owner of a cryptographic key used to generate electronic signatures or seals is liable to third parties for any damage they have suffered as a result of relying on a valid certificate issued by a provider of certification services within the meaning of the Federal Act of 18 March 201633 on Electronic Signatures.
2 The owner is absolved of liability if he can satisfy the court that he took all the security precautions that could reasonably be expected in the circumstances to prevent misuse of the cryptographic key.
3 The Federal Council defines the security precautions to be taken pursuant to paragraph 2.

1 Il titolare di una chiave crittografica utilizzata per generare firme o sigilli elettronici è responsabile dei danni cagionati a terzi che si sono fidati di un certificato regolamentato valido rilasciato da un prestatore di servizi di certificazione riconosciuto ai sensi della legge del 18 marzo 201633 sulla firma elettronica.
2 La responsabilità decade se il titolare può rendere verosimile di aver adottato le misure di sicurezza necessarie secondo le circostanze e ragionevolmente esigibili per impedire un abuso della chiave crittografica.
3 Il Consiglio federale definisce le misure di sicurezza ai sensi del capoverso 2.
