814.600 Ordonnance du 4 décembre 2015 sur la limitation et l'élimination des déchets (Ordonnance sur les déchets, OLED)
Art. 39 Construction permit
1 The cantonal authority shall grant the construction permit for a landfill or a compartment provided:
- a.
- the requirements for landfill volume and the location of the landfill are indicated in the waste management plan;
- b.
- the requirements under Article 36 for the location and building of landfills are met.
2 In the construction permit, it shall specify:
- a.
- the type the landfill or of the compartment;
- b.
- any restrictions on the acceptable waste in accordance with Annex 5;
- c.
- further requirements and conditions that are necessary for compliance with the environmental and waters protection legislation.
Art. 39 Autorisation d’aménager
1 L’autorité cantonale délivre l’autorisation d’aménager une décharge ou un compartiment:
- a.
- si le besoin du volume de stockage et le site de la décharge sont inscrits dans le plan de gestion des déchets;
- b.
- si les exigences de l’art. 36 concernant le site et l’ouvrage de la décharge sont respectées.
2 Elle fixe dans l’autorisation d’aménager:
- a.
- le type de la décharge ou du compartiment;
- b.
- les éventuelles restrictions concernant les déchets admis selon l’annexe 5;
- c.
- les autres charges et conditions requises pour assurer le respect de la législation sur la protection de l’environnement et sur la protection des eaux.
