Art. 41 Licensed land surveyors

1 Licensed land surveyors who have successfully completed the federal state examinations and who are registered in the Register of Licensed Land Surveyors are authorised to perform independent (self-employed) work within Cadastral Surveying.

2 An administrative body of the Confederation comprising representatives from the Confederation, the cantons and the professional associations shall:

a.
conduct the state examinations;
b.
maintain the register and issue or refuse the licence to practise;
c.
exercise disciplinary supervision over those persons entered in the register.

3 The Federal Council shall issue detailed regulations concerning:

a.
the education required to obtain the licence to practise;
b.
the professional and individual conditions necessary for registration;
c.
the management of the register and the issuing of licences to practise;
d.
the composition, appointment and organisation of the administrative body;
e.
the responsibilities of the administrative body and the management;
f.
deletion from the register and other disciplinary measures;
g.
the professional duties of the persons entered in the register;
h.
the financing of the state examinations, the maintenance of the register and other activities of the administrative body.

Art. 41 Ingénieur géomètre

1 Quiconque a réussi l’examen d’État et est inscrit au registre des ingénieurs géomètres est en droit de procéder à l’exécution indépendante de travaux de la mensuration officielle.

2 Une autorité fédérale composée de représentants de la Confédération, des cantons et des organisations professionnelles:

a.
fait passer les examens;
b.
tient le registre et délivre ou non le brevet;
c.
exerce la surveillance disciplinaire des personnes inscrites au registre.

3 Le Conseil fédéral édicte des dispositions détaillées concernant:

a.
la formation nécessaire à l’obtention du brevet;
b.
les conditions requises au plan technique et personnel pour l’inscription;
c.
la tenue du registre et la délivrance du brevet;
d.
la composition, la désignation et l’organisation de l’autorité;
e.
les compétences de l’autorité et de l’administration;
f.
la radiation du registre et d’autres mesures disciplinaires;
g.
les obligations professionnelles des personnes inscrites au registre;
h.
le financement de l’examen, de la tenue du registre et des autres activités de l’autorité.
