1. Any person who wilfully causes a flood, the collapse of a structure or a landslide or rock fall and thus knowingly endangers the life and limb of people or the property of others shall be liable to a custodial sentence of not less than one year.
If only minor loss, damage or injury is caused, a custodial sentence not exceeding three years or a monetary penalty may be imposed.
2. If the person concerned acts through negligence, the penalty is a custodial sentence not exceeding three years or a monetary penalty.
1. Celui qui, intentionnellement, aura causé une inondation, l’écroulement d’une construction ou un éboulement et aura par là sciemment mis en danger la vie ou l’intégrité corporelle des personnes ou la propriété d’autrui sera puni d’une peine privative de liberté d’un an au moins.
Le juge pourra prononcer une peine privative de liberté de trois ans au plus ou une peine pécuniaire si le dommage est de peu d’importance.
2. La peine sera une peine privative de liberté de trois ans au plus ou une peine pécuniaire si le délinquant a agi par négligence.
