Art. 164 Reduction of assets to the prejudice of creditors

1.  Any debtor who reduces his assets to the detriment of his creditors by

damaging, destroying or reducing the value of any assets or rendering them unusable,

disposing of any assets for no consideration or for a consideration that is clearly negligible in value,

or by waiving, without material grounds, any rights which may accrue thereon or by renouncing rights for no consideration,

shall be liable, if bankruptcy proceedings are commenced against him or a certificate of unsatisfied claims has been issued in his respect, to a custodial sentence not exceeding five years or to a monetary penalty.

2.  Subject to the same requirements, any third party who carries out any of the foregoing acts to the prejudice of creditors shall be liable to a custodial sentence not exceeding three years or to a monetary penalty..

Art. 164 Diminution effective de l’actif au préjudice des créanciers

1.  Le débiteur qui, de manière à causer un dommage à ses créanciers, aura diminué son actif

en endommageant, détruisant, dépréciant ou mettant hors d’usage des valeurs patrimoniales,

en cédant des valeurs patrimoniales à titre gratuit ou contre une prestation de valeur manifestement inférieure,

en refusant sans raison valable des droits qui lui reviennent ou en renonçant gratuitement à des droits

sera, s’il a été déclaré en faillite ou si un acte de défaut de biens a été dressé contre lui, puni d’une peine privative de liberté de cinq ans au plus ou d’une peine pécuniaire.

2.  Le tiers qui, dans les mêmes conditions, se sera livré à ces agissements de manière à causer un dommage aux créanciers sera puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire.
