Art. 142

1 The law applicable to a tort determines in particular the capacity to be liable in tort, the conditions and the extent of liability, as well as the person liable.

2 Rules of conduct and safety in force at the place of the act are taken into consideration.

1 Le droit applicable à l’acte illicite détermine notamment la capacité délictuelle, les conditions et l’étendue de la responsabilité, ainsi que la personne du responsable.

2 Les règles de sécurité et de comportement en vigueur au lieu de l’acte sont prises en considération.
