The commission agent is not permitted to act as buyer or seller if the principal has withdrawn his mandate and the notice of withdrawal reached the commission agent before he dispatched the notice of execution.
Lorsque le commissionnaire peut se porter personnellement acheteur ou vendeur et qu’il annonce au commettant l’exécution du mandat sans lui désigner un contractant, il est réputé avoir assumé lui-même les obligations qui incomberaient à ce dernier.
